Description: AP neglected AV as defined in OAR 411-020-0002(1)(b)(A)(i) by passively or actively failing to provide basic care or services necessary to maintain the health and safety of AV, which resulted in emotional harm, unreasonable discomfort, or serious loss of personal dignity.

Findings: The facility failed to appropriately care plan for the Alleged Victim after he/she suffered an injury to his/her back on 12/24/2019. On or about 2/18/20, AV requested help with his/her shower, Alleged Perpetrator #2 (AP2) answered the call light and AV was taken aback about an opposite sex caregiver giving him/her a shower. Having a shower by an opposite sex caregiver created emotional harm to AV. The facility failed to update AV's care plan to his/her preferences regarding help with showers and other cares. The investigation determined no wrongdoing or abuse on the part of AP2. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
