- Alleged Victim (AV) was care planned to have staff help AV lock the door when he/she was in his/her room. On or about October 14, 2019, Witness 1 (W1) entered AV’s unlocked room while AV was present, resulting in an altercation when AV threw a room temperature drink on W1 and W1 scratched AV’s arm and hand, causing skin injuries to AV. W1 and AV had a previous similar altercation where W1 entered AV’s room resulting in a skin injury to AV. W1’s care plan was not updated at that earlier incident and did not have sufficient instructions on how to monitor or prevent W1 from these behaviors. The facility’s failure to follow AV’s care plan and failure to implement appropriate interventions according to W1’s known behaviors are a violation of resident rights, are considered neglect of care and constitutes abuse.
