- Because the facility closed prior to the completion of this investigation report, no Civil Penalty can be levied against this owner for this action. The facility failed to provide a safe environment, failed to implement appropriate interventions and provide adequate supervision according to Alleged Victim’s (AV) known behaviors. The investigation revealed that AV’s bed had multiple cigarette burns and his/her room smelled of cigarette smoke and urine. Facility staff were aware of this but did not provide AV a new room or provide a new mattress until an outside entity requested it. The facility's failures are a violation of resident rights, are considered neglect of care and constitutes abuse.
