Findings
On or about October 15, 2019, Witness 3 (W3) touched Alleged Victim (AV) in a sexual manner causing AV discomfort and emotional pain. AV has cognitive deficits that effect his/her ability to provide consent for sexual contact. The facility was aware of W3's sexual behavior and failed to protect AV from W3's unwanted sexual advances which is a violation of resident rights, is considered neglect of care and resulted in negative behavior.
