- Alleged Victim (AV) had a history of aggressive behaviors and was care planned to be monitored while in the house and for staff to intervene when AV is in another resident’s space. On or about October 23, 2019, AV was sitting next to Witness 4 (W4) and grabbed a book out of W4’s hands and hit W4 several times in his/her face. W4 hit AV back with a brush, causing AV to sustain a skin injury on his/her hand. Staff did not intervene when AV was in W4’s space before the incident. The facility failed to provide adequate supervision to AV which resulted in physical harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
