- The Alleged Victim (AV) was care planned as having a nut allergy and the facility was to have an Epi-pen on hand for the AV in the event of an allergic reaction. On or about December 31, 2019, Alleged Perpetrator #2 (AP2) fed AV a peanut butter sandwich, which led to AV having an allergic reaction. Facility staff proceeded to give AV the Epi-pen shot, however, the epi-pen was expired, which was known by staff for months prior to this incident. AV was sent to the hospital for evaluation and care of anaphylactic shock. The facility failed to have unexpired medication on hand for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse. AP2 failed to provide a safe environment for AV by feeding him/her food that he/she was allergic to, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
