- Alleged Victim (AV) had a known history of riding his/her scooter side saddle and had been injured on multiple occasions due to riding his/her scooter side saddle. On or about January 10, 2020, AV fell off his/her scooter because he/she was sitting side saddle and attempted to stand up on the side of the scooter causing the scooter to fall on top of his/her. AV sustained a head injury and contusions to his/her arms and legs during the incident. The facility failed to care plan according to AV's known history of riding his/her unsafely, which is a violation of resident rights, is neglect of care and constitutes abuse.
As of June 4, 2020, you are the new owner of this facility, you are responsible for correcting any deficiencies which pre-date your ownership. You must correct violations which occurred under previous ownership, as directed by the Department. You will not be responsible for paying civil penalties incurred by previous owner(s). However, if you fail to correct identified deficiencies within the specified time you may be subject to aggravated civil penalties.
