Findings
Alleged Victim (AV) and Witness 1 (W1) were in the living room area and had been redirected from each other because W1 was violently shaking and moving AV's walker. Facility staff were assisting other residents not in the living room area. Staff responded to screaming coming from the living room and found AV on the floor with his/her walker on top of him/her. AV stated W1 pushed him/her down. W1 gestured that AV was trying to hit W1 with his/her walker. AV complained of shoulder pain due to the incident. The facility failed to provide a safe environment, which is a violation of resident rights, is neglect of care and constitutes abuse.
