- Alleged Perpetrator 2 (AP2) and another staff were providing toileting assistance to Alleged Victim (AV). AP2 admitted to making a comment that made AV physically upset which was apparent by AV's shaking and crying. AP2's actions are considered verbal/emotional abuse. AV is care planned a two person assist with using the restroom. Staff threatened AV to be moved to the memory care unit due to his/her needs. AV uses a power chair for mobility. AV's power chair was stored in another room and AV had to use the call button to alert staff to bring the power chair to his/her room. AV was known to finish his/her meal quickly and return to his/her room and use the restroom. AV was known to push his/her call button frequently. The facility failed to care plan appropriately and provide enough staff to meet the scheduled and unscheduled needs of AV which is a violation of resident rights, is neglect of care and constitutes abuse.
**On August 11, 2020 the facility closed, therefor a civil penalty will not be issued.**
