- On or about March 20, 2020, Alleged Victim (AV) was woken up by Alleged Perpetrator 3 (AP3), when AP3 was attempting to care for AV's roommate. Shortly after, AV walked into the medication room and became physically aggressive towards Alleged Perpetrator 2 (AP2). AP2 pushed AV and AV fell to the ground. AV was unable to get up from the floor without staff assistance. While on the floor, AV was crying and asking AP2 for help to get up from the floor. AP2 refused to help AV up from the floor because AV was agitated. AP2 yelled to AV in a mocking tone "We are trying to treat you with respect but you don't give a fuck."AV asked AP3 for assistance off the floor and AP3 refused to help AV off the floor. AP2 and AP3 left AV on the floor of the hallway outside of the medication room to smoke a cigarette. AV was not monitored while staff were outside smoking. AV was on the floor, unable to get up for approximately one hour and twenty one minutes. AP2 and AP3 refusing to assist AV is considered neglect of care and constitutes abuse. The facility failed to protect AV from abuse, which is a violation of resident rights, is neglect of care and constitutes abuse.
