Findings
Witness 1 (W1) had known inappropriate sexual behaviors and the facility failed to care plan according to those behaviors. The facility failed to address W1's sexual behaviors when he/she was observed making sexual comments towards Alleged Victim (AV) in the common area, after W1 was observed feeling AV’s thigh in W1’s room, and after W1 was observed caressing AV’s breasts. The facility failed to put sufficient interventions in place to protect others from W1's inappropriate sexual behavior which is a violation of resident rights, is considered neglect of care and constitutes abuse.
