- The facility failed to follow Alleged Victim's (AV) care plan which resulted in the facility neglecting to provide AV the basic care and services necessary to maintain health and safety, creating a risk of serious harm to AV and other residents. On or about May 3, 2020, AV was found to be extremely agitated. AV was observed running in the hallway, hitting staff, and calling staff names. AV was redirected by staff and seated between two other residents. AV became more agitated when he/she attempted to leave and slapped one of the residents he/she was seating by. AV is care planned for ongoing monitoring for any changes in mobility, confusion, and mood. The facility's intervention to seat AV next to other residents when he/she was agitated placed AV and other residents at risk of serious harm. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
