- Alleged Victim (AV) has multiple mental health diagnosis and behaviors related to his/her diagnosis. On or about March 22nd and March 23, 2020, AV refused his/her medication. AV did not speak to his/her medical provider prior to stopping the medication. The facility had a policy that residents agree to take their medications as ordered by their medical providers. On or about March 23, 2020, Alleged Perpetrator 2 (AP2) had a conversation with AV regarding AV’s medication refusal. AV perceived the conversation as a threat that he/she would be removed from the facility and lose his/her pets if he/she did not resume taking medications. AV’s service plan and behavior support plan does not address AV’s known history of medication refusals nor did the facility contact AV’s medication prescriber for direction. The facility’s failure to respond to AV’s medication refusal appropriately is a violation of resident rights, in neglect of care and constitutes abuse as defined in OAR 411-020-0002(1)(b)(A)(i).
