- Alleged Victim (AV) relies on facility staff for his/her care. On or about November 11, 2020, AV reported that a caregiver of the opposite gender touched him/her "wrong" and care staff were too "rough." AV requested only staff members of the same gender provide care to AV however AV continued to ask for assistance from opposite gender staff members. The facility did not complete any investigation into AV's allegations. On or about November 11, 2020, AV reported that Alleged Perpetrator 2 (AP2), an opposite gender caregiver provided care to AV and was rough, rude and splashed cold water on AV. AV reported feeling afraid of AP2. The facility failed to implement appropriate interventions to protect AV from emotional harm due to being provided care from an opposite gender caregiver, which is a violation of resident rights, is neglect of care and constitutes abuse.
