- Alleged Victim (AV) has a diagnosis of progressive neurodegenerative disorder and often sits in the reclining chair in the common area of the facility. On or about December 5, 2020, AV was sitting in the recliner in the common area with the footrest up. AV made attempts to get out of the recliner and Alleged Perpetrator 2 (AP2) cued AV to continue to sit in the chair as AP2 believed that AV was attempting to get up due to baseline anxiety. AV continued to attempt to get out of the recliner and fell. AP2 was the only caregiver present and was providing care to another resident when AV fell. The facility failed to provide a safe environment and failed to provide sufficient staff to meet the scheduled and unscheduled needs of a resident, which is a violation of resident rights, is neglect of care and constitutes abuse.
