Findings
On or about December 25, 2020, Alleged Perpetrator #2 (AP2) assisted the Alleged Victim (AV) to the restroom. AP2 failed to place AV's walker in front of the restroom, which is common practice. AP2 assisted other residents and forgot about AV in the restroom, leaving him/her there for approximately 1 1/2 to 2 hours before he/she was found by other staff. AV was found in the restroom, unharmed, other than a red mark and indentation on his/her bottom. AP2's actions are a violation of resident rights, is considered neglect of care and constitutes abuse. The facility failed to have enough staff present to meet the scheduled and unscheduled needs of the residents, placing AV at risk for harm. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
