- Alleged Victim (AV) relies on the facility for his/her care. AV suffers from significant cognitive deficits. On or about December 23, 2020, staff found AV in Witness’s 1 (W1’s) bed. AV was wearing a torn brief and W1 was naked from the waits down. Staff attempted to separate AV and W1, which caused AV to become violent towards staff and for W1 to attempt to throw furniture at staff. AV believed that W1 was his/her spouse since W1 repeatedly told AV that they were married. AV and W1 were difficult to keep separate, due to their known behaviors. AV and W1 were noted to be spending time together following the December 23, 2020 incident including multiple occasions in which AV slept in W1’s bed during the night. The facility failed to care plan according to AV’s known behaviors which is a violation of resident rights, is neglect of care and constitutes abuse.
