- Alleged Victim (AV) relies on the facility for his/her care needs, AV is not oriented to people, place, time, or situation. On or about November 11, 2020, AV was found in Witness’ 1 (W1’s) bed by staff; both residents were undressed. After speaking with AV and W1, the facility determined they were in a relationship and the facility would conduct intimacy questionnaires to determine if the contact was consensual. No changes were made to AV’s or W1’s service plan to direct staff on how to monitor AV and W1’s behaviors and determine if AV was continually consenting to contact with W1. On or about January 14, 2021, AV was found in W1’s bed unresponsive. AV was transported to the emergency department and diagnosed with a urinary tract infection. The facility failed to care plan in accordance with AV’s assessment, which is a violation of resident rights, is neglect of care and constitutes abuse.
