Findings
Alleged Victim (AV) has limited mobility, cannot bear weight, and requires one-two persons assistance with gait belt and sit to stand transfers. On or about April 19, 2021, Alleged Perpetrator 2 (AP2) was called to AV's room to assist with a transfer. AV requested AP2 to transfer him/her in a way that AP2 felt was unsafe and refused to complete the transfer as requested. AP2 reported concerns promptly and requested another staff go assist AV. The facility failed to update AV's service plan to reflect AV's needs regarding transferring, which is a violation of resident rights, is neglect of care and constitutes abuse as defined in OAR 411-020-0002(1)(b)(A)(i).
