- The facility failed to provide a safe environment for Alleged Victim (AV) by failing to protect AV from Alleged Perpetrator 2's (AP2) inappropriate behaviors when AP2 was working in the role of AV's caregiver. An investigation determined that AP2 spent time in AV's room watching AV's television instead of working as AV's caregiver, AP2 ate food from AV's refrigerator and took AV's snacks without permission, AP2 slept in AV's recliner during NOC shift, and when AV asked for assistance to use the toilet, AP2 told AV to urinate in his/her briefs which caused AV emotional harm. The facility failed to address AP2's behaviors when reported by AV and failed to take protective action after multiple concerns were reported regarding AP2's behaviors. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse. AP2 financially exploited AV by taking, borrowing, and accepting property belonging to AV, a resident of the facility, while AP2 was employed as a caregiver at the facility. AP2's actions is considered financial Exploitation which constitutes abuse.
