- Alleged Victim (AV) relies on the facility for his/her care. On or about October 5, 2021, AV, and Witness 1 (W1) were involved in an altercation. As a result, AV sustained two (2) scratches down the gith side of AV’s neck and had re-opened wounds/scabs on his/her left shoulder from W1 scratching. AV and W1’s service plan both stated that neither have a history of harming self and others. However, there has been a previous altercation between AV and W1 on or about August 28, 2021. The facility was aware that AV and W1 had been having altercations since they lived at the independent living facility, their prior placement. The facility failed to provide a safe environment for AV, resulting in AV sustaining injuries, which is a violation of resident rights, is neglect of care and constitutes abuse.
