Findings
The Alleged Victim (AV) was speaking to him/herself while rolling past the kitchen area. Witness #2 (W2) and AV have a history of altercations. On or about December 4, 2021, W2 heard AV speaking to him/herself, which evidently triggered W2 and he/she reached out and began choking and shaking AV. Staff intervened, however, AV was placed at risk for harm. The facility failed to provide a safe environment, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
