- Under prior ownership: The facility and AP2 failed to implement the Alleged Victim's (AV) behavioral support plan for his/her known aggression. AV was then moved into a Memory Care Unit without AP2 notifying or receiving direction from AV's Physician, Case Manager, Behavioral Support Specialist, or family. The move to the Memory Care exacerbated AV's aggression as s/he was not informed of the move, or that the unit was locked. AV was sent to the hospital twice due to his/her aggression in the Memory Care. AP2's actions are considered involuntary seclusion which constitutes abuse. The facility's failure to ensure AV received appropriate care related to his/her behaviors is a violation of resident rights, is considered neglect of case and constitutes abuse.
