- The Alleged Victim (AV) relies on the facility for his or her care. On or about July 10, 2022, the facility ran out of AV’s PRN anxiety medication. There are at least four (4) documented instances between July 10, 2022 and July 29, 2022, that AV suffered from anxiety and the facility did not have AV’s anxiety medication available, which caused AV unreasonable discomfort. The facility failed to administer medication as ordered, which is a violation of resident rights is considered neglect of care and constitutes abuse.
Amendment: Additional documented evidence was obtained via a discovery request and subpoena for ODHS’s review and consideration. On July 3, 2024, after reviewing the additional evidence, ODHS has concluded that the abuse determination is modified from Substantiated to Not Substantiated.
