- Alleged Victim (AV) is a resident and under the care of the locked facility for the safety of the resident. AV has a history of eloping and getting lost. From approximately October 09, 2022 to October 31, 2022, AV attempted to the exit through the window twice.
On or about October 31, 2022, AV was awake and agitated, and staff decided to give AV space. AV was able to slide opened the window, push out the screen and crawled through the window. A resident notified staff about AV missing. The facility called police who found AV at least .40 miles away in a grocery store parking lot. It was dark and the weather was 53 degrees with fog and rain. AV reports receiving an injury to the knee when AV crawled out of the window, but documents state AV hurt AV's hand/arm. The facility failed to ensure the screws that held the window lock in pace were tight and secure. The facility failed to provide a safe environment, and an appropriate safety plan around Av’s elopement behaviors, which is a violation of resident’s rights, is considered neglect of care and constitutes abuse.
