- Witness 1 (W1) has a known history of resident-to-resident altercation and becoming verbally abusive. On or about December 15, 2022, Alleged Victim (AV) reported to management that W1 was verbally abusive, and that AV avoids W1 in the hallways, AV will not ride on the elevator with W1 due to vulgar language and verbal abuse by W1. On or about January 5, 2023, W1 was in a verbal altercation with another resident at the facility, during the altercation W1 made verbal threats of harm the other resident. On or about January 9, 2023, W1 was inside the facility elevator waiting to go downstairs when AV approached the elevator, W1 became angry that AV was entering the elevator and began cussing and verbally insulting AV, W1 picked up his/her wheelchair and swung it towards AV as W1 left the elevator. The facility became aware that W1 was demonstrating physical aggression and verbally abuse language towards staff and residents in December 2022 and failed to put safeguards in place to protect AV from emotional and physical harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
