Findings
The Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) is known to have aggression toward other residents and not to respond appropriately when surprised by others. According to an investigation, on or about March 18, 2023, W1 punched AV multiple times when AV tried to use W1’s wheelchair for leverage when he/she was rolling past W1. The facility failed to provide a safe environment to AV and appropriate care plan for W1’s known behaviors, which is a violation of resident rights, is neglect of care which constitutes abuse.
