Findings
Witness 1 (W1) has a history of resident-to-resident altercations. On or about May 1, 2023, Alleged Victim (AV) was trying to get into his/her room; AV’s door was locked and at this time, W1 walked up behind AV and punched AV in the face near his/her cheekbone with a closed fist. As a result, AV was shaken and confused and had redness on his/her cheek. The facility failed to provide a safe environment for AV, leading to AV sustaining an injury, which is a violation of resident rights, is neglect of care and constitutes abuse.
