Findings
Witness #1 (W1) is known to have behaviors and is care planned to be redirected and isolated from other residents when having behaviors. On or about May 3, 2023, W1 exited his/her room and appeared agitated. Staff then heard the Alleged Victim (AV) calling for help. Staff entered AV's room and found AV on the floor. AV is unable to get out of bed by him/herself. W1 had urinated on the floor and then pulled AV out of bed, onto the floor and into W1's urine. AV was cold to the touch and shivering. The facility's failure to follow the care plan placed AV at risk for harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
