Findings
The Alleged Victim (AV) has a history of violent and sexualized behaviors and was placed on one to one care to avoid altercations with other residents. On or about February 22, 2023, Staff found AV choking Witness #4 (W4). Staff separated the two and in retaliation, W4 came up behind staff and AV and punched AV in the back, resulting in redness where he/she had been hit. The facility's failure to follow AV's care plan resulted in W4 hitting AV in the back. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
