- Alleged Victim (AV) relies on the facility for his/her care. AV refused personal care and got into a verbal altercation with Alleged Perpetrator 2 (AP2) over AV refusing personal care. This altercation resulted in AP2 spraying Lysol into AV’s room as they left the room. Alleged Perpetrator 3 (AP3) got into a verbal argument with AV due to AV refusing personal care. AP3 told AV they’d never be independent again and that escalated to AP3 telling AV they could beat them up. Ap2 and AP3 failed to protect AV from verbal abuse, which is a violation of resident rights, is neglect of care and constitutes abuse. The facility failed to protect AV from verbal abuse, which is a violation Oregon Administrative Rules.
