- On or about June 29, 2023, Alleged Victim (AV) had a fall resulting in a fractured wrist. AV was taken to the hospital for treatment and a fiberglass cast was placed on AV's right arm. Hospital discharge instructions stated AV needed follow-up with AV's doctor 3 days after the hospital discharge. Based on interviews and facility documentation, AV's dressing was taken off on September 1, 2023, with the same dressing AV got at the hospital on June 29, 2023. The fracture healed with AV's wrist and fingers significantly displaced. AV's wrist and fingers were flexed and not able to straighten out normally. AV's hand was still very swollen when the fiberglass cast was removed from his/her right arm. The facility's failure to provide basic care and services necessary to maintain AV's health and safety resulted in AV experiencing pain and unreasonable discomfort for a long period of time. The facility's failure is a violation of residents rights, is considered neglect of care, and constitutes abuse.
