- The Alleged Victim (AV) is a known fall risk and is known to try to self-transfer. AV is care planned for safety checks every two three hours. Staff checked on AV at midnight and Alleged Perpetrator #2 (AP2) checked on AV at 3:00 am and should have checked AV's brief at that time. At approximately 6:00 am on September 11, 2023, AV was found on the floor of his/her room, and his/her brief was soaked. AV was not injured, however, AV did suffer unreasonable discomfort from being on the floor for an unknown amount of time and being soaked. AP2 did not check AV after 3:00 am and had given agency staff a list of residents, stating that AV was independent. No residents within the facility are independent. AP2's actions are a violation of resident rights, are considered neglect of care and constitute abuse. The facility's failure to ensure AV was care for properly is a violation of Oregon Administrative Rules.
