Findings
On or about September 29, 2023, Alleged Victim (AV) and Witness 1 (W1) had an altercation in the dining room in which W1 pushed AV to the ground and kicked AV in the lower back. The facility failed to appropriately monitor W1 and AV according to their known behavior and prior altercations. The failure resulted in a physical altercation, causing unreasonable discomfort to the AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
