- The facility failed to provide appropriate supervision related to the Alleged Victim’s (AV) known history of falls. On or about November 8, 2023, AV tripped over his/her shoes and fell to the floor near his/her bed. Based on documentation and interviews, AV pushed his/her call button to summon help from staff; staff did not respond to AV's request timely resulting in AV lying on the floor for 43 minutes after the fall, experiencing unreasonable discomfort through pain to his/her side, arm, and hand. AV was transported to the hospital for treatment. The facility's failure to schedule enough staff to answer AV's call light timely resulted in unreasonable discomfort when AV fell on and laid on the floor in pain for an extended period of time which is a violation of resident rights, is considered neglect of care and constitutes abuse.
