- Alleged Victim (AV) has aggressive behaviors and a history to get in physical resident-to-resident altercations. Interventions in place to reduce AV’s behaviors are to offer AV a snack, offer to walk with AV, offer to sit with AV, and redirect AV away from other residents until AV calms down. If the incident happens in the dining room, staff report they can intervene quickly otherwise they cannot; Staff report interventions are effective 50% of the time. AV and Witness (W1) have a history of resident-to-resident altercations with other residents and each other. AV tends to target W1 because W1 has food and other items in h/h room that AV likes. On December 9, 2023, AV and W1 were involved in a physical resident-to-resident altercation in the hallway; W1 was yelling at AV and then threw a cup of water at AV; W1 then hit AV so AV started to hit W1 back. Investigator’s review of the video did not show W1 hitting AV, but shows AV appear to hit W1 on the hands approximately 7 to 8 times. AV sustained skin tears on h/h hands and was visibly upset by the altercation. It is unknown if W1 sustained the dark purple skin discoloration on h/h left wrist and forearm from the incident. Between September 7, 2023, and December 8, 2023, AV was involved in 8 physical resident-to-resident altercations.
The facility failed to provide a safe and homelike environment, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
