Witness 1 (W1) is known to get into resident-to-resident physical altercations and has aggressive behaviors. Alleged Victim (AV) and W1 have a history of resident-to-resident altercations with each other. W1 tends to target AV because AV has food and other items in h/h room that W1 likes. Interventions in place to reduce W1’s behaviors are to offer W1 a snack, offer to walk with W1, offer to sit with W1, and redirect W1 away from other residents until W1 calms down. Staff report W1 will walk around the facility all day long and it is hard to keep track of someone who is not in a wheelchair like AV. On or about December 9, 2023, AV and W1 were involved in a physical resident-to-resident altercation in the hallway. AV had been a little agitated throughout the shift. AV was sitting in h/h wheelchair in the hallway when W1 walked by. AV was yelling at W1 and then threw a cup of water at W1; a review of the video did not show AV hitting W1 but shows W1 appear to hit AV on the hands approximately 7 to 8 times. W1 sustained skin tears on h/h hands and was visibly upset by the altercation. AV sustained dark purple skin discoloration on h/h left wrist and forearm likely caused by the incident. The facility failed to appropriately adjust care plans and implement reasonable interventions to address AVs and W1s continued aggressive behaviors, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
