- The facility failed to implement interventions and appropriately monitor Witness 1 (W1) according to his/her known behavior and prior altercations. On or about December 5, 2023, W1 became agitated when he/she saw Alleged Victim (AV) and pushed AV into his/her room causing AV unreasonable discomfort. W1 is known to become agitated without warning. The facility's failure to protect AV from W1's aggressive behavior resulted in a physical altercation which is a violation of resident rights, is considered neglect of care and constitutes abuse.
