Findings
Alleged Victim (AV) relies on the facility for h/h care. On or about January 6, 2024, AV walked into a common area of the facility without a shirt on. The Alleged Perpetrator (AP2) yelled at AV to put a shirt on, and when AV did not comply, AP2 cursed and yelled at AV again. AP2 then grabbed AV's hips and forced AV to their room. Once in the room AV attempted to pull away from AP2's physical hold and both AV and AP2 fell to the ground, causing AV to injury their thumb. AP2’s actions are a violation of resident rights, are considered neglect of care, wrongful restraint, and verbal/emotional abuse. The facility failed to ensure a safe environment, which is a failure of Oregon Administrative Rules.
