- The Alleged Victim (AV) relies on the facility for care and is a known fall risk. AV is care planned for staff to assist with putting socks and shoes on every morning and if AV is observed without his/her walker, staff are to locate it and remind AV to use it. According to an investigation, AV did not like to use their walker or wear shoes. Facility staff were unsure what to do if the AV was resistant to care which resulted in AV having repeated falls, some with injury, and prolonged the healing of AV's toe wound. The facility failed to provide appropriate services to respond to AV’s behaviors, which caused repeated unreasonable discomfort, is a violation of resident rights, is considered neglect of care and constitutes abuse.
