- Alleged Victim (AV) receives assistance with activities of daily living, including skin care and bed mobility. Staff are to assist AV with regular repositioning and brief changes. AV has chronic pain and requires staff to be gentle with slow movements during care. On or about February 17, 2024 Alleged Perpetrator 2 (AP2) was assisting with AV's brief change. AP2 repositioned AV and pulled AV's incontinence pad out quickly causing AV to cry out in pain. Witness 2 (W2) intervened to stop AP2 from being rough with AV. AP2 has a history of being rough with AV in the past, and AV has requested AP2 be gentle during cares. AV is fearful of AP2 responding to AV's care needs, so AV often does not request assistance with care. AP2 has been trained in direct care aspects. Facility management has been made aware of complaints against AP2 and about AP2 being rough during cares, however no formal documentation or action has been taken to address or correct AP2's behavior.
AP2’s actions are a violation of resident rights, are considered neglect of care and constitute physical abuse. The facility failed to provide a safe environment, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
