- The Alleged Victim (AV) and Witness 2 (W2) both rely on the facility for their care. Both AV and W2 have a history of aggressive behaviors and physical altercations with each other. According to an investigation, on or about March 23, 2024, care staff found both AV and W2 with injuries consistent with an altercation, and AV stated that he/she had hit another resident. The facility failed to implement interventions and/or appropriately care plan for AV and W2's known behaviors and provide a safe environment for AV, causing unreasonable discomfort, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
