- Alleged Victim (AV) is minimally oriented and relies on the facility staff to ensure that h/h personal care, safety, and supervision requirements are met. AV does not have the ability to speak or to consent to sexual contact. Witness 1 (W1) Service plan dated on or around April 8, 2024 indicates W1 grabs at residents, kisses (other residents). W1 is oriented to person and place, but not time. There are days when W1 can be confused and need cues and reminders. W1 ISP on or about April 4, 2024 indicates to monitor W1 for signs of increased agitation, stalking other residents, increased sexual advances, or trying to kiss other residents. On or about April 17, 2024 W1 was put on alert for sexual behaviors, and ISP indicates to monitor for sexual behaviors, more frequent checks. On or about April 22, 2024 Progress notes indicate W1 kept stalking another resident no additional interventions were placed. On or about April 23, 2024 W1 was stalking AV at the beginning of shift, W1 approached AV and kissed AV. The facility failed to appropriately care plan and implement reasonable interventions to mitigate W1's ongoing inappropriate sexual behaviors and failed to provide adequate supervision to W1, which resulted in W1 kissing AV without consent.
