- On or about May 5, 2024, Alleged Victim (AV) wandered into Witness 1 (W1’s) room. W1 grabbed AV’s arm and pulled AV out of W1’s room. AV grabbed a hold of the wall to keep balance. Witness 3 (W3) walk away with AV. W1 shut W1’s door and came back into the hallway. AV and W1 both walked back towards the couch in the hallway and W3 went into another resident’s room. AV reached down onto the couch to pick up W1’s phone and W1 grabbed it back from AV and pushed AV’s left shoulder open handed and AV fell backwards and hit AV’s head on the hallway wall. AV had blood in AV’s mouth after hitting AV’s head on the wall. AV had previously been involved in resident-to-resident altercations due to attempting to take items from other residents. W1 has previously been involved in resident-to-resident altercations where W1 was upset after another resident touched his belongings. W1 specifically does not like other people to touch W1’s phone. AV has previously fallen as a result of resident-to-resident altercations. There are no interventions in place to address AV’s behavior of taking the belongings of other residents. There are no interventions in place to address W1’s trigger of other residents touching W1’s belongings and/or phone besides redirecting residents if they are seen approaching W1’s phone or wallet. The facility failed to appropriately care plan and implement reasonable interventions to address W1’s behaviors, which resulted in physical harm to AV when AV fell and hit AV’s head on the wall after being pushed by W1 during a resident-to-resident altercation, which is violation of resident rights, is considered neglect of care and constitutes abuse.
