- The Alleged Victim (AV) and Witness 6 (W6) both rely on the facility for their care and have a history of physical altercations with each other that includes multiple injuries and W6 requiring hospitalization for a brain bleed. There are multiple interventions that were in place to mitigate AV’s aggressive behaviors, but facility staff didn’t always follow them due to being busy. According to an investigation, AV and W6 got into an altercation on May 3, 2024, resulting in W6 punching AV, causing unreasonable discomfort. The facility failed to follow and/or implement effective interventions for AV and W6, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
