Findings
The Alleged Victim (AV) relies on the facility to provide his/her care. Witness 1 (W1) has a history of behaviors and resident-to-resident physical altercations. According to an investigation, on or about June 18, 2024, AV was walking past W1 in the dining room when W1 punched AV in the face and chest causing AV to fall, then stabbed AV in his/her arm with a pen. The facility failed to provide a safe environment to AV when the facility failed to implement interventions and appropriately care plan related to W1's known behaviors and recent history of altercations. The facility’s failure is a violation of resident's rights, is neglect of care and constitutes abuse.
