- On or about July 1, 2024, Alleged Victim (AV) was slapped with an open hand on his/her right side of face and neck during a resident-to-resident altercation between AV and Witness 1 (W1). W1 is a resident at the facility with a known history of physical aggression with attempts to hit both residents and staff. Based on facility documentation and interviews, W1 was observed wandering the halls. W1's care planned to be redirected by care staff when W1 is seen wandering the halls of the facility. The facility failed to appropriately monitor Witness 1 according to his/her known behavior and prior altercations. The failure resulted in a physical altercation causing unreasonable discomfort to the AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
