- Witness 5 (W5) has a history of becoming verbally and physically aggressive with other residents. Alleged Victim (AV) relies on the facility for his/her care. On or about July 8, 2024, AV and W5 were seated next to one another in the common area. W5 became agitated by AV and hit AV on the arm. Three (3) staff were working in the immediate area however were not looking when they heard AV yell “ouch”. The facility failed to provide a safe environment to AV, which put AV in risk of harm, which is a violation of resident rights, is neglect of care and constitutes abuse.
