- Witness 1 (W1) is known to randomly hit residents and staff and may become triggered when other residents attempt to redirect W1. Alleged Victim (AV) has never had a resident-to-resident altercation. If W1 is showing aggressive tone or behavior from other residents, W1 may retaliate with physical aggression. If W1 is walking around anxious, agitated, or aggressively staff are to redirect other residents away from W1. Staff are to offer beverages and have one-on-one conversation to provide comfort to W1 when W1 is agitated. W1 has behavioral medications, but s known to refuse medications. On or about July 14, 2024, W1 was walking around the unit, walked up to AV and took AV's clothing off the back of AV's wheelchair. AV told W1 to give it back and W1 hit AV on the face, causing AV's earring to come out and cause AV to experience pain. Staff were helping other residents with their back to AV and W1. Staff are not consistent with mitigating W1's behaviors. The facility failed to provide a safe environment, adjust the service plan and properly plan care for W1 leading to continued aggressive behavior., which is a violation of resident rights, is considered neglect of care and constitutes abuse.
