Alleged Victim (AV) and Witness 1 (W1) have history of altercations with other residents but not each other. W1 has a history of resident-to-resident altercations involving residents near W1’s room, occurring on September 18, 2024, and October 02, 2024. W1 Service Plan dated October 19, 2024, contains the following information, Witness 1 (W1) does not like noise from neighboring residents in the hallway by h/h room, W1 does not like any noise outside of W1's apartment while W1 is sleeping or watching television. W1 will Screaming at staff and other residents, move residents away from h/h door. Intervention includes medications, intervention dated on or about September 18, 2024, staff to keep W1's door locked as W1 allows, and intervention dated on or about October 2, 2024 staff to redirect other residents seen standing outside of W1's room to another part of the building. AV Service Plan dated on or about September 26, 2024, contains the following information, AV does not like when people try and push h/h in h/h wheelchair, active triggers people being in h/h space. On or about September 2, 2024, AV was involved in an altercation with another resident when propelling around the facility. Interventions include if AV is seen propelling around the halls, staff are to offer h/h a snack and offer to bring AV to the current activity going on. Additional interventions noted if staff observe AV getting close to other residents where AV can grab at them, they are to redirect and offer h/h hot coffee. On or about November 10, 2024, AV was in h/h wheelchair in the hallway outside of W1's door. W1 came out of h/h room and began yelling at AV. In response to W1's yelling AV began hitting the wall with h/h right hand and W1 grabbed AV by the hair. AV began swinging h/h arm behind their body in an attempt to get W1 to release h/h hair and W1 grabbed AV's hand and attempted to bite AV. Staff responded and separated AV and W1. AV stated the back of h/h head hurt after the incident. The facility failed to follow AV care plan by staff not offering h/h a snack and offer to bring AV to the current activity going on. The facility failed to follow W1 care plan by not redirecting other residents seen standing outside of W1's room to another part of the building, which is violation of resident rights, is considered neglect of care and constitutes abuse.
